A legal challenge against US sanctions 

In early August, Joseph Kabila formally approached the American judicial system. His objective is to secure the removal of his name from the blacklist maintained by the Office of Foreign Assets Control (OFAC), the US Treasury Department entity responsible for enforcing economic sanctions. In a sixteen-page complaint, his legal team disputes Washington’s decision, asserting that the accusations against him lack sufficient substantiation. 

Kabila refutes the accusations 

American authorities allege that the former president provided both financial and logistical backing to the Alliance Fleuve Congo (AFC), a political and military coalition where the M23 group serves as the primary component. Washington further accuses him of inciting Congolese soldiers to desert and of residing in Goma, located in eastern RDC, under the protection of the M23. Joseph Kabila categorically denies these claims. His defense argues that the evidence presented by the US administration is “vague” and “arbitrary,” failing to concretely establish the alleged facts. 

The defense demands concrete evidence 

Attorneys representing the former president specifically highlight the absence of any identified precise financial transfers to the AFC within the American dossier. They also state that no Congolese military personnel are explicitly named as having been encouraged to desert by Joseph Kabila. Furthermore, his defense points out that in 2013, during his presidency, the Congolese army played a crucial role in defeating the M23.  

A legal battle amidst eastern RDC crisis 

Joseph Kabila, who governed the DRC from 2001 to 2019, is now petitioning the federal court in Washington to lift the sanctions and remove his name from the OFAC list. This legal action unfolds as the M23 and the Alliance Fleuve Congo remain central to the ongoing conflict in eastern RDC, where diplomatic efforts persist in an attempt to achieve a political and security resolution.
